Before accepting any kind of commission, I require that the commissioner reads and accepts my full terms of service. Failure to read does not mean you're exempt from my rules. Breaking my terms of service could result in you getting blacklisted from my services in the future.
Please note that:

ADOPTABLES | REFERENCES | PAYMENT | PROCESS | USAGEThese rules apply to adoptables you are sold and characters I have sold.
You can upload adoptables sold by me to toyhouse! Please be sure to credit me on-site @Auccultist.
I don't keep track of adoptable sales beyond the initial purchase. Make sure to do your own research when buying my designs that aren't sold by me.
I don't offer refunds after characters have been transferred.
The character/adoptable does not belong to you until fully paid off. Until that point, they remain in my possession. I remain the right to cancel incomplete transactions at any time.
If you file for a chargeback after receiving the files/character, you automatically rescind any ownerships rights and they fall into my possession once again.
You get full rights to adoptables sold by me, meaning you can edit/change/use them however you'd like once they're purchased. All I ask is that I'm given credit for the design and any art made by me.
When purchasing characters I'm selling, you are buying the design and not the character itself. This means that you aren't allowed to re-use the character's biography information. You are purchasing their physical form, not the concept of the character.
Purchasing a character design doesn't give you the right to trace or repurpose the artwork. I do not condone tracing my work.
The following applies to any instance of you commissioning work from me- this includes but isn't limited to commissioned work, YCHs (Your Character Here)s, and customs.
The only references I will take are digital reference sheets. I will not take traditional references, screenshots, or descriptions. The only exception to this is if I am being commissioned to make a reference sheet/custom. If details aren't provided in a reference sheet, I may make artistic choices myself. (For instance, if your character doesn't have a mouth reference or paw colours provided, I may pick some myself.)
I may simplify complex markings for small commission types such as icons, pixels and dinks. Sometimes it isn't possible to include such intricate details on tiny canvses. I will not simplify designs on larger commission types unless stated otherwise.
Make it clear what you want when commissioning me. Image references are incredibly useful when it comes to backgrounds and poses and I will happily reference images provided. Please avoid sharing artwork and use pictures only when doing so.
You are paying for stylised art. This means that I will be drawing the character in my style and how I interpret them. I may minorly tweak colours to better suit my style and make characters clearer for me to draw. These tweaks will not be noticable in final pieces.
For customs, I can work from moodboards, descriptions, single images, or songs. I can also do artistic freedom customs or customs based on usernames. I will not make a design based on other people's characters or characters you do not have the rights to use. If you have the rights to use a design, I can redesign them or make child designs.
If you change your character's design during the commission process and fail to inform me, I am not responsible for getting their design wrong. Similarly, if you majorly change a design in the middle of a commission that will require me to rework a lot of the work I have already done, I retain the right to refuse the changes or cancel and partially refund the commission for the work not completed.
Please send payment in USD amount listed or GBP equivalent. I don't accept other forms of currency as it costs me to exchange.
I am open to discussing payment plans for large commission types. I will only accept payment plans on amounts larger than $75. A down-payment of $75 must be paid on the day that the commission is accepted. If you don't keep up to date with payments or fail to follow up, I hold the right to cancel the commission and refund any funds I have been sent so far (minus the paypal fee).
I will only start the commission after receiving the full payment for the commission.
I don't offer refunds by the request of the buyer as all sales are final. If for whatever reason I'm unable to complete the commission for my own reasons, I will offer a refund. If I am refunding you (the commissioner) due to harrassment or improper conduct, I will only refund for the work not completed, and will not refund the work in full.
Filing for a chargeback will get you permanently blacklisted from future transactions. Filing for a chargeback means you forfeit the rights to the piece, and I may remake and sell to whomever I like. I will likely sell forfeited pieces as YCHs to make up for lost time and money.
To streamline the commission process, I mostly communicate and send updates through Discord.
Once receiving the payment for the commission in full, I will begin to work on your commission. For small commissions (like icons, dinks, and pixels) you will only receive one sketch. You may ask for any edits or changes beforee I proceed. If I am working on a larger piece of art, you will receiving multiple sketches to choose from or ask to be tweaked before I move on.
You only have the rights to the finished artwork. Any unused or rejected sketches I will likely reuse or repurpose as YCHs.
You can ask for minor changes throughout the whole commission process. Major changes and making changes after parts of the commission are approved may end up costing extra. For example, if you have approved the lineart of a piece and I move onto the colouring and shading, asking for edits on the already approved lineart may cost extra.
I will not take commissions with a deadline unless fully discussed at least a month before the deadline. You may not impose deadlines after I have accepted a commission. I can't always take commissions with deadlines.
You may ask for updates and WIPs at any point during the commission process. I keep my trello extremely up to date as well and it always displays exactly where I am on your commission and where you are in my queue.
I will ask for approval between each stage of larger commissions. For example, if I finish lining I won't begin colouring until you have approved the lineart.
Commissions will take as long as they will take. It's rare that anyone has to wait more than 3 weeks for a commission from me. If for whatever reason my commissions are delayed, you will be notified.
You can upload the finished piece to toyhouse! Please remember to credit me on-site @Auccultist.
I retain the right to post (or not post) my finished commissions on any of my social medias at any time.
You may repost my finished commission work only if you are the owner of the character in the piece. And you must give me full credit for my artwork. Linking to my socials is highly appreciated.
You aren't allowed to remove/edit/crop out my watermarks or signature. You also aren't allowed to draw over or edit my work.
You may not use my artwork commercially (on merchandise, as prints, etc) unless discussed otherwise. This includes any kind of NFT or block-chain related works- I do not condone my work being used like this.
